The Trade Marks –
(a) Which are without any unmistakable character, that is to say, not fit for recognizing the products or administrations of one individual from those of someone else;
(b) Which comprise only of imprints or signs which might serve in exchange to assign the kind, quality, expected reason, values, geological source or the season of creation of the products or rendering of the administration or different attributes of the merchandise or benefit;
(c) Which comprises only of imprints or signs which have ended up standard in the present dialect or in the real and set up practices of the exchange,
Should not be enlisted:
Given that an exchange mark should not be rejected enlistment if before the date of utilization for enrollment it has gained an unmistakable character as an aftereffect of the utilization made of it or is a surely understood exchange mark.
